Leon Walker of Rochester Hills, Mich., is facing felony charges under an anti-hacking statute. Walker hacked into his wife’s Gmail account to check up on her. His defense, however, is that it was not hacking, and it was to protect their child.

On February 7, Leon Walker will be tried. Anti-hacking statutes are the main reason the reason why Leon Walker was even arrested. There was a purpose for writing the laws. It was intended to keep government computers from being hacked and prevent identity theft. Walker may be in prison up to five years if convicted of hacking. Leon Walker found out that his wife had been unfaithful to him by logging into his wife’s Gmail account which is when the crime supposedly occurred.

The lawyers and Leon Walker say that he did go into his wife’s e-mail account. He states that his wife had a habit of leaving her passwords written on pieces of paper around the house. He also states the laptop he used was purchased after they were married and was shared between the 2 of them. The Gmail would be left open on the shared computer often. Leon Walker explains that this was frequently happening.

Leon Walker is saying his wife had no “reasonable expectation of privacy,” although that may not be the only thing for him to go with. Walker says that he checked his wife’s e-mail out of concern for her child’s safety. She did not come home one night so he checked her e-mail. One of his concerns was that she was spending time with her first husband. He was convicted of child abuse though. Walker was worried so he printed the e-mails. He then sent them to the father of the child who was Walker’s second husband. When questioned, the second husband revealed the e-mails came from Leon Walker.
