Loughner, the 22-year-old accused Tucson shooter, had his arraignment hearing in federal courtroom in Phoenix, accounts The Arizona Republic. Clad in an orange jump suit and shackled by the wrists to belly chains, Loughner’s displays of weird conduct in court seemed to suggest that a not guilty by reason of insanity plea was forthcoming, yet such was not the case. Defense attorney Clarke asked United States District Judge Larry Burns to enter a plea of merely "not guilty" for her client.
Loughner's plea punctuated by smirks, frivolity
There were several responses to how Loughner acted in the courtroom during the hearing. He went between scrunching his face and laughing. Clarke has not talked yet about Loughner's ability to stand trial.
Two counts of attempted murder of Pam Simon and Ron Barber who are both federal employees as well as one count of attempted assassination of Rep. Gabrielle Giffords who’s a member of Congress are the things Loughner is being charged with. In addition, Assistant United States Lawyer Wallace Kleindienst told Judge Burns that further charges against Loughner are anticipated in 30 days to address the murders of U.S. District Judge John Roll and Giffords aide Gabe Zimmerman.
During Monday's arraignment hearing, the charges were waived by lawyers.
Seeing Loughner again March nine in court
There could be a status conference in courtroom in either Tucson or Phoenix that Jared Loughner can have to go to. There is really only one reason for it. The dates for Loughner's trial could be set.
The death penalty is a possible verdict that could fall upon Loughner because of the murder of federal employees. Civilians Phyllis Schneck, Dorwin Stoddard, Dorothy Morris and Christina Taylor Green were also murdered. Bias has been the reason why AZ federal judges have all taken themselves off the case. The Tucson shooting case can be done by another judge. Judge Burns traveled from San Diego to Phoenix into order to preside over the Loughner case.
